ಕರ್ನಾಟಕ ವೈದ್ಯಕೀಯ ಪರಿಷತ್ತಿಗೆ ಐವರು ಸದಸ್ಯರನ್ನು ಕೂಡಲೇ ನಾಮನಿರ್ದೇಶನ ಮಾಡುವಂತೆ ರಾಜ್ಯ ಸರಕಾರಕ್ಕೆ ಆದೇಶ ನೀಡಬೇಕೆಂದು ಕೋರಿ ಡಾ. ಶ್ರೀನಿವಾಸ ಕಕ್ಕಿಲ್ಲಾಯ ಸಲ್ಲಿಸಿರುವ ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿ ಅರ್ಜಿಯನ್ನು ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯವು ಇಂದು ಎಪ್ರಿಲ್ 22, 2024ರಂದು ದಾಖಲಿಸಿಕೊಂಡಿದ್ದು, ಪ್ರತಿವಾದಿಗಳಿಗೆ ನೋಟೀಸ್ ಜಾರಿ ಮಾಡುವಂತೆ ಆದೇಶಿಸಿದೆ.
ಕರ್ನಾಟಕ ವೈದ್ಯಕೀಯ ಪರಿಷತ್ತಿಗೆ ಜನವರಿ 2020ರಲ್ಲಿ ಚುನಾವಣೆಗಳು ನಡೆದು 12 ಸದಸ್ಯರು ಆಯ್ಕೆಯಾಗಿದ್ದರು. ಆದರೆ ಇದನ್ನು ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಶ್ನಿಸಲಾಗಿದ್ದರಿಂದ ಈ ಹೊಸ ಸದಸ್ಯರು ಸುಮಾರು 4 ವರ್ಷ ಅಧಿಕಾರ ವಹಿಸಿಕೊಳ್ಳಲು ಸಾಧ್ಯವಾಗಿರಲಿಲ್ಲ; ಕಳೆದ ನವೆಂಬರ್ 2023ರಲ್ಲಿ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ಕಲಬುರಗಿ ಪೀಠವು ಚುನಾವಣೆಯನ್ನು ಮಾನ್ಯ ಮಾಡಿದ ಬಳಿಕವಷ್ಟೇ ಈ ಸದಸ್ಯರು ಅಧಿಕಾರ ವಹಿಸಿಕೊಂಡರು.
ಆ ನಡುವೆ ಜನವರಿ 2020ರಲ್ಲಿ ಪರಿಷತ್ತಿನ ಚುನಾವಣೆಗೂ ಮೊದಲೇ ರಾಜ್ಯ ಸರಕಾರವು 5 ಸದಸ್ಯರನ್ನು ನಾಮ ನಿರ್ದೇಶನ ಮಾಡಿತ್ತು. ಇದನ್ನು ಕೂಡಲೇ ಪ್ರಶ್ನಿಸಿ ಜನವರಿ 2020ರಲ್ಲೇ ಡಾ. ಶ್ರೀನಿವಾಸ ಕಕ್ಕಿಲ್ಲಾಯ ಸಲ್ಲಿಸಿದ್ದ ರಿಟ್ ಅರ್ಜಿಯ ಮೇಲೆ ಮಾನ್ಯ ನ್ಯಾಯಾಲಯವು ನೀಡಿದ ನಿರ್ದೇಶದಂತೆ ರಾಜ್ಯ ಸರಕಾರವು ಈ ನಾಮನಿರ್ದೇಶನಗಳನ್ನು ಹಿಂಪಡೆದಿತ್ತು.
ಈಗ ಚುನಾಯಿತ ಸದಸ್ಯರು ಅಧಿಕಾರ ವಹಿಸಿಕೊಂಡು ನಾಲ್ಕು ತಿಂಗಳಾದರೂ ಈ 5 ನಾಮನಿರ್ದೇಶಿತ ಸ್ಥಾನಗಳನ್ನು ತುಂಬಲು ಸರಕಾರವು ಮುಂದಾಗಿರಲಿಲ್ಲ. ಇದರಿಂದಾಗಿ ಪರಿಷತ್ತಿನ ಅಧ್ಯಕ್ಷ ಹಾಗೂ ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳಿಗೆ ಚುನಾವಣೆಗಳು ನಡೆದಂತಾಗಿ ಹಿಂದಿನ ಪರಿಷತ್ತಿನಲ್ಲಿದ್ದ ಇಬ್ಬರು ತಮ್ಮ ಸದಸ್ಯತ್ವವನ್ನು ಕಳೆದುಕೊಂಡಿದ್ದರೂ ಅಧ್ಯಕ್ಷ ಹಾಗೂ ಉಪಾಧ್ಯಕ್ಷ ಸ್ಥಾನಗಳಲ್ಲಿ ಮುಂದುವರಿಯುವ ಪರಿಸ್ಥಿತಿ ಸೃಷ್ಟಿಯಾಗಿತ್ತು.
ಈಗ ಚುನಾವಣಾ ನೀತಿ ಸಂಹಿತೆಯ ನೆಪದಲ್ಲಿ ನಾಮನಿರ್ದೇಶನವೂ, ಹೊಸ ಅಧ್ಯಕ್ಷ ಹಾಗೂ ಉಪಾಧ್ಯಕ್ಷರ ಚುನಾವಣೆಗಳೂ ಇನ್ನಷ್ಟು ತಡವಾಗುವ ಸಾಧ್ಯತೆಗಳನ್ನು ಮನಗಂಡು ಪ್ರಸ್ತುತ ರಿಟ್ ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಲಾಗಿತ್ತು.
ಅದೇ ರೀತಿ, 5 ಸದಸ್ಯರನ್ನು ತಕ್ಷಣ ನಾಮನಿರ್ದೇಶನ ಮಾಡುವಂತೆ ಹಾಗೂ ಅಧ್ಯಕ್ಷ ಹಾಗೂ ಉಪಾಧ್ಯಕ್ಷ ಹುದ್ದೆಗಳಲ್ಲಿರುವ ಡಾ. ಕಂಚಿ ಪ್ರಲ್ಹಾದ್ ಮತ್ತು ಡಾ. ನಾಗರಾಜ್ ಅಣ್ಣೇಗೌಡ ಅವರು ತಮ್ಮ ಸ್ಥಾನಗಳನ್ನು ತ್ಯಜಿಸುವಂತೆಯೂ ಆದೇಶಿಸಬೇಕೆಂದು ಕೋರಲಾಗಿತ್ತು. ಮಾನ್ಯ ಉಚ್ಚ ನ್ಯಾಯಾಲಯವು ಅದನ್ನು ದಾಖಲಿಸಿಕೊಂಡು ಎಲ್ಲಾ ಪ್ರತಿವಾದಿಗಳಿಗೆ ನೋಟೀಸ್ ಜಾರಿಗೊಳಿಸಿದೆ.
Karnataka High Court admits and issues notices on PIL seeking immediate nominations to the Karnataka Medical Council
The Hon'ble Karnataka High Court today (April 22, 2024) admitted the PIL (Writ Petition WP 10463/2024) filed by Dr Srinivasa Kakkilaya seeking order or direction to the respondent no. 1 Karnataka Government to nominate members to the respondent no. 2 Karnataka Medical Council and issued notices to the respondents.
Elections to the Karnataka Medical Council were held in January 2020, but due to legal challenge, the assumption of office by the newly elected members was delayed by nearly 4 years, and the new members could assume office in November 2023 following the order by the Hon'ble High Court at Kalaburagi that upheld the elections.
Meanwhile, the Karnataka govt had nominated 5 members to the KMC in January 2020, even before the elections, and the same was immediately challenged by Dr Srinivasa Kakkilaya, and on the directions of the Hon'ble High Court in Dec 2020, the government had to withdraw all these nominations.
Even after the assumption of office by the newly elected members 4 months ago, the government has not nominated 5 members to the vacant posts, and due to that, the new President and Vice President of the Medical Council have not been elected, and two of the earlier members of the Council have continued to officiate in these positions.
With the election code of conduct in force, the nominations to the KMC, a constitutional quasi judicial body, is further delayed. The petitioner therefore filed the present PIL writ petition seeking orders for immediate nominations to the medical council and for the immediate vacation of offices by Dr. Kanchi Pralhad and Dr. Nagaraj Annegowda who are now officiating as President and Vice President even while not being elected members of the Council. The Hon'ble High Court has admitted this PIL and issued notices to all the respondents.
